Each state has its own Work Health and Safety Act and each state places the primary health and safety duty on a person conducting a business or undertaking (PCBU) to ensure, as far as is reasonably practicable, the health and safety of workers, contractors and visitors at the workplace. If a business fails to address WHS then penalties apply which are generally 60 Penalty Units.
